초록

시장의 상벌기능은 사회적 필요 충족 행위를 포상하고 자원낭비를 징벌하는데, 개인의 사적 이익 추구가 사회적 필요 충족으로 이어질 때 가장 잘 작동한다. 자원을 더 효율적으로사용하는 개인이 더 많이 포상받는다면 이기적 개인은 자원의 효율적 이용에 힘쓸 것이다.
자원의 효율적 사용능력은 생산자의 공정한 경쟁력이고 경쟁력이 강한 공급자는 시장거래에서 강한 협상력을 행사하여 응분의 포상을 취득한다. 각종 인위적 진입장벽은 경쟁력의 공정성을 무너뜨려 시장경쟁을 불공정하게 이끌기 때문에 경쟁정책의 핵심은 부당한 진입장벽의 해소라야 한다. 그러나 현실 경제에는 시장을 선점한 기존 사업자 지위로부터 특허권과 과거 영업행위가 구축한 평판에 이르기까지 각종 진입장벽이 이미 존재하고 있다. 이 장벽들은 부당한 것도 아니고 해소할 수도 없기 때문에 현실의 경쟁법은 해당 사업자들이 이 진입장벽에 기대어 독점, 담합, 그리고 우월적 지위의 남용 등 각종 불공정행위를 단속하는 내용으로 편성되어 있다. 그러나 경쟁정책의 핵심은 최근의 필수설비원칙이나 특허권의 강제라이센스에서도 나타나듯이 진입장벽의 해소다.

영어초록

The prize-penalty mechanism of market awards prizes to individual behaviors that fulfill social needs and penalizes otherwise, and functions best when pursuit of private interests satisfies social needs. Selfish individual will use resources efficiently only when it pays her to do so. Fair competing power comes from efficient use of resources to generate fair bargaining power which will in turn bring due prize. The core of the competition policy must be the one that eliminates all the unfair artificial barries to entry, since the entry-barriers are the ultimate source unfair competition. In practice, however, there is a wide range of entry barriers from the position of incumbency through lawful patent or copyrights to good brand built by good past performances, each of which is neither unlawful nor easy to eliminate. Therefore the competition laws of real world mainly address to monopolization, collusion, and abuse of dominant position making use of these entry barriers. The core of competition law,however, is the elimination of the unfair entry barriers, and this trend is well-revealed in recent adoption of essential facility doctrine and compulsory licensing of patent rights.
