복지는 어떻게 ‘사업’이 되었는가:한국 사회복지법인의 역사로 본 형제복지원 (How did social welfare become ‘business’?: ‘Hyeongje-welfare Institution’ and trajectory of social welfare foundation in Korea)

초록

이 글은 1980년대 전국 최대 규모의 ‘부랑인수용시설’이었던 부산 형제복지원 사건의 의미를 한국 사회복지법인의 역사의 맥락에서 살펴보는 것을 목적으로 한다. 즉 총체적 기관(total institution)으로서의 형제복지원이 아니라, 시설을 운영했던 법인체로서의 ‘사회복지법인형제복지원’의 역사가 주된 검토대상이다. 법인체에 초점을 맞춤으로써 우리는 형제복지원 사건을 해석하는 주된 프레임이었던 ‘국가범죄론’에서 상대적으로 간과되었던 대상들, 즉 복지시설을 운영했던 민간 행위자들의 이해관계, 그리고 사회복지 관련 법･제도의 맥락 등을 보다 면밀하게 검토할 수 있다.
1965년 설립된 형제복지원 재단의 1987년까지의 역사는 크게 1) 외원에 의존하여 운영되었던 ‘재단법인형제육아원’ 시기(1965-1970), 2) 법인형태의 전환과 직업보도사업의 운영, 부산시와의 위탁계약 체결을 통해 비약적 성장의 계기를 마련한 ‘사회복지법인형제원’ 시기(1971-1979), 3) 국고보조금 등 정부 지원에 의존하여 사업 다각화를 진행한 ‘사회복지법인형제복지원’ 시기(1980-1987)로 구분될 수 있다. 각각의 시기는 재정구조, 정부-재단관계, 지배구조 등에서 뚜렷한 차이를 보이지만, 몇 가지 지속적 경향 역시 관찰된다. 시설은 대형화되었고, 정부와 재단 사이의 담합관계는 공고해졌으며, 재단의 사유화 역시 가속화되었다.
이러한 형제복지원 재단의 궤적은 한국 민간 사회복지영역의 역사를 긴밀히 반영하고 있었다. 형제복지원은 하나의 ‘예외’적 사건이라기보다는, 한국전쟁 이후 급격히 팽창한 민간 의존적 복지체계의 독특한 발전경로와 그에 내재된 난점을 극적으로 보여주는 ‘전형’적인 사례에 가깝다. 형제복지원 재단 사례의 보편성과 특수성, 그리고 사회복지영역에 남겨진 그 유산에 대한 본격적 질문과 성찰이 필요한 이유이다.

영어초록

In this article, I examined the meaning of 'Hyeongje-welfare Institution' incident in the context of historical trajectory of social welfare foundations in Korea. Specifically, this article focuses on the foundational juridical person that operated 'Hyeongje-welfare Institution', rather than welfare institution as 'total institution'. This approach enables us to clarify the interests of welfare agency who tried to appropriate socio-economic opportunities, which have been neglected in the 'state crime' approach.
The history of 'Hyeongje-social welfare foundation' can be divided into three phases. In each phase, the foundational entity had diverse financial structure, government-foundation relations, and governance structure. Nevertheless it is possible to identify the gradual tendency into the diversification of field of work, privatization of foundation and collusion with the government agency.
In this sense, 'Hyeongje-welfare Institution' case was not an 'exceptional' incident in the history of social welfare in Korea. Rather, it shows dramatically the peculiar historical trajectories of private welfare sector in Korea, and intrinsic contradictions within it. More through investigation would be required on the universal/particular character of 'Hyeongje-welfare Institution' case, and institutional legacy of vagrancy asylums left on the post-democratization period.
