초록

현대 한국정치의 가장 고질적인 문제는 집단의 자기보존을 우선시하는 생존의 프레임과 결합된극단적 도덕주의가 법치국가의 제도적 절차성을 훼손하고 공적인 가치를 형해화시키는데 있다. ‘도덕의 정치화’와 ‘정치의 도덕화’로 요약할 수 있는 이러한 한국정치의 문제는 서구의 자유주의 법치국가이론가들이 주장하는 제도의 절차적 합리성으로 해결될 수 없는 한국정치의 고유한 특성과 관련되어있다. 이것은 제도의 절차적 합리성을 강조하는 이론의 서구중심적 성격을 보여주는 것이기도하다. 이러한 한국정치의 한계를 극복하기 위해서는 집단 간의 도덕 갈등을 조정하고 민주적인 제도의 절차적 합리성을 보충하는 조정의 기제가 필요하다. 본 논문은 이러한 조정의 기제를 헤겔 정치사상에 대한 재구성을 통해 헌법의 규범성에 기초한 공적 윤리의 기제 안에서 발견한다. 이를 위해본 논문은 헤겔 정치사상에 나타나는 공적인 윤리의 상이한 규범적 층위를 서로 기능적으로 보충하며 연결되어 있는 하나의 ‘체계’로 재구성하고자 한다. 본 논문에서 재구성한 헌법의 규범적 가치에토대를 둔 공적 윤리의 체계는 현대 한국사회에서 이루어지는 도덕의 정치화가 갖는 한계를 성찰할수 있는 규범적인 틀을 제공할 것이다.

영어초록

This study attempts to suggest a way to overcome a problem in Korean politics by reformulating the structure of public ethics in Hegel’s political thought. The enduring problem in Korean political scene is the survival politics for self-preservation, which is based on the ‘politicization of morality’. Enhancing procedural rationality cannot solely resolve this problem that is deeply embedded in Korean politics. To resolve this difficulty, a mechanism of political steering that can supplement procedural rationality is called for. By reinterpreting Hegel’s political thought, this article suggests that public ethics could be reconstructed as a normative system of political steering that functionally connects various dimensions of socio-political norms. The system of public ethics in Hegel’s political thought is reconstructed in three dimensions: ethics based on reciprocity, sociocultural dimensions related to ethical sentiment of a community, and normative aspects tied to constitution as the system of political institutions. This renovated system of public ethic which is based on normative instance of the constitution provides a theoretical framework to rethink about the politicization of morality in Korean politics.
