우리나라 규제개혁 추진 과정에 관한 고찰: 규제개혁 거버넌스와 민관협력 성과를 중심으로 (A Critical Review on Regulatory Reform of Korea: Focusing on Regulatory Governance and Public-Private Cooperation)

초록

이 연구는 1998년 이래 우리나라 규제개혁 추진과정의 규제개혁 거버넌스를 일견한 후 그 성과를 규제개혁 추진 구조와 운영과정 그리고 민관협력의 관점에서 분석하여 시사점을 제공하는 것을 목표로 하고 있다. 시장의 복잡성이 증가하면서 규제개혁 추진과정에 민간 참여 및 민관 협력이 필수적으로 확대될 것으로 예상해 볼 수 있다. 그러나 이 연구의 분석 결과를 살펴보면 그 동안 규제개혁이 시장의 자율적 질서 창달을 보장하기 보다는 하위 정책의 목표 달성 수단으로 활용되는 경우가 많았고, 민관협력을 통한 체계적인 규제개혁 보다는 단순한 민간 참여 보장 수준에서 추진된 경우가 더 많았다는 점을 보여준다. 보다 실효성 있게 시장 자율성을 보장하기 위해서는 민관협력 관점에서 규제개혁에 대한 광범위한 투자와 전문성의 확보, 그리고 지속적인 규제개혁 추진이 중요한 것으로 확인되었다.

영어초록

This article aims to demonstrate some implications on the public-private cooperation in regulatory reform of korea through analyzing the regulatory reform history from 1998. The importance of public-private cooperation in regulatory reform is rapidly increasing due to the growing complexities of market. But the result of this research shows that, at least in korea, the regulatory reform hardly functions as or offers a basin of spontaneous market order. Rather, it is easier to find the cases that regulatory reform works as a policy tool for accomplish the goal of a sub-policy of industry policy and is much easier to discover the situations where public-private cooperation functions only as a mechanism of private participation. To guarantee or to increase market autonomy, vast investment on building sophisticated public-private cooperation system in regulatory reform, develop expertise on the institution, and relentless regulatory reform implementation is essential.
