북극권 쟁점과 북극해 거버넌스 (The Issues and Oceans Governance in the Arctic)

초록

지난 2년간 기후변화로 해빙과 빙하의 녹는 속도가 가속화되자, 자원과 항로의 개발이 추진되고, 따라서 북극의 해양환경도 위기 상황에 이르렀다. 이제는 모두의 관심사인 북극의 쟁점과 해양환경문제를 다룰 완전한 국제기구의 창설이나 지역 해양협정의 체결을 통해 북극해의 해양 거버넌스를 강화할 시점이다.
북극권 국가들간의 관계는 결코 많은 이들이 생각하는 것처럼 부정적이지 않다. 더 일반적으로, 이미 북극에서 상당 부분의 협력이 이루어지고 있다는 사실을 언급할 필요가 있다. 군사적 갈등이나 영토와 자원을 둘러싼 분쟁의 가능성은 자원의 매장량만큼 크지 않다.
게다가 완벽하진 않지만, 잠재적으로 훨씬 더 많은 북극의 쟁점들에 해결책을 제공할 법률적 구조가 존재한다. 해양 경계선과 대륙붕의 외측한계를 설정할 원칙들과 규칙들이 '해양의 헌법'이라 할 수 있는 LOSC에 규정되어 있고, 관련국 모두 협약의 가입국들이다.
북극해와 공통의 도전을 공유한 북극권 국가들은 이미 상당한 정도 협력하고 있고 또 적절한 협력의 원칙들과 선례가 존재한다. 이제 남은 것은 새로운 지역 해양협정과 북극의 지속가능한 발전을 위한 노력을 조직화하고 공고화할 정치적 의지만 찾으면 된다.

영어초록

With the race to develope natural resouces and new passage as a result of accelerated melting of sea ice and glaciers in the past two years, the Arctic marine environment has reached a crisis point. It is now time to consider creating the Arctic Regime by the adoption of a regional seas agreement and by the establishment of a fully-fledged international organisation to address marine environmental issues of global concern.
Relations between the Arctic Rim states are by no means as negative as many people believe. More generally, it should be noted that there is already a considerable amount of cooperation in the Arctic. The vision of military conflict or a battle for territory and resources is wholly imaginary.
In addition, there is a firm legal structure providing a solution for many Arctic issues with a potential for much more. The principles and rules for establishing maritime boundaries and the outer limits of the continental shelf are set out in the LOSC as the Constitution for the Oceans, and all of the states involved are pursuing those routes.
The Arctic Rim states, sharing a common ocean(the Arctic) and common challenges already cooperate to a considerable extent to protect the environment and marine ecosystem. And there also exist the relevant principles and precedents. The last thing to do left for the Arctic states is to find the political will to go one step further to organise and consolidate their efforts in a new regional seas agreement and a future plan for sustainable development in the Arctic.
