공인회계사 전문직업인 배상책임보험에서 보험사고(claim)의 개수에 관한 연구 - 대법원 2021. 12. 30. 선고 2017다294202 판결 - (A Study on the Number of Claims in Professional Reparations Liability Insurance of Certified Public Accountant)

초록

공인회계사 전문직업인 배상책임보험은 피보험자인 회계사가 회계업무를 수행하던 중 과실로 인하여 법률상 손해배상책임을 부담함으로써 입게 되는 손해를 보상하는 전문직 배상책임보험이다. 전문직 서비스의 증가와 더불어 의뢰인의 권리의식은 향상되면서 전문직업인들의 업무 중 과실로 인해 의뢰인과 분쟁이 발생하는 사례가 늘어가고 있고, 이로 인해 배상책임보험의 수요도 확대되어 가고 있다. 그런데 전문직업인 배상책임보험의 대부분이 영문약관을 기준으로 작성되어 있어, 약관의 해석과 관련한 분쟁이 발생하고 있다.
이런 상황에서 최근 공인회계사 전문직업인 배상책임보험에 대한 의미있는 대법원 판결(이하 ‘대상판결’이라 한다)이 선고되어, 본 논문에서는 이를 살펴보았다. 대상판결은 회계법인인 원고와 보험회사인 피고 사이의 분쟁으로, 공인회계사 전문직업인 배상책임보험에서 보험사고(이하 ‘클레임’이라 한다)의 개수를 몇 개로 보아 자기부담금을 몇 회 공제할 것인지가 쟁점이었다. 이 사건 보험의 ‘클레임’이 회계법인인 원고의 회계감사 과실로 인한 손해배상책임이라는 점은 명확하나, 보상한도와 자기부담금 공제를 위한 ‘클레임의 개수’를 어떻게 인정할 것인지가 문제 되었다. 이에 대해 1심, 항소심, 상고심은 모두 2개 사업연도에 행해진 원고의 회계감사행위의 과실을 기준으로 2개의 클레임으로 본다고 판단하였다. 이에 본 논문에서는 대상판결의 사실관계 및 소송의 경과를 살펴보고, 공인회계사 전문직업인 배상책임보험에서 ‘클레임’과 ‘자기부담금’의 의의에 대해 살펴본 후, 이 사건 보험의 ‘클레임 개수’에 대한 대법원의 판단을 차례로 검토하였다.

영어초록

Professional reparations liability insurance of certified public accountant is a professional liability insurance that compensates for damages incurred by the insured accountant’s legal liability due to negligence while performing accounting. With the increase in professional services and the improvement of clients' rights and consciousness, the number of cases in which professional workers have disputes with clients due to negligence during work is increasing, and as a result, the demand for reparations liability Insurance is also increasing. However, because most of professional reparations liability insurance is composed of English policies, there are disputes with regard to the interpretation.
The three representative occupations of professional reparations liability insurance are lawyers, doctors, and certified public accountants, and recently a meaningful Supreme Court ruling(hereinafter referred to as the "target judgment") regarding the professional reparations liability insurance was sentenced, and this thesis examined this ruling. The target judgment was a dispute between the plaintiff, an accounting firm, and the defendant, an insurance company, and the issue was how many insurance accidents(hereinafter referred to as "claim") would be considered to deduct from self-payment in professional reparations liability insurance of certified public accountant. It is clear that the "claim" of the insurance in this case is the liability for damages caused by the audit negligence of the plaintiff, an accounting firm, but the problem was how to recognize the "number of claims" for the guarantee limit and deduction of self-payments. In response tho this the first-trial, the appellate court, and the final appeal court all regarded as two claims based on the negligence in the account audit act conducted by the plaintiff in two accounting years. Hereupon, in this paper, the fact relations of the target judgment and the progress of litigation were examined, and after inspecting the significance of 'claim' and 'self-payment' in professional reparations liability insurance, this paper reviewed the Supreme Court's judgment on the number of ‘claims’ of insurance in this case.
