드론 규제의 법적 쟁점 및 전망

초록

최근 드론 산업이 급속도로 발전함에 따라 관 련된 법적 문제들이 하나둘씩 드러나고 있다. 특 히 드론을 이용한 범죄수사는 개인의 프라이버시 침해를 야기하므로 기본권 보호를 위한 법적 장치 마련이 시급한 상황이다. 이에 본 논문에서는 항 공법상 드론 관련 규제 및 개인정보보호법상 드론 의 감시와 관련된 프라이버시 보호장치를 살펴보 고 미국의 법제와 국내 법령을 비교 분석하고자 한다. 특히 영장주의와 관련하여 형사소송법상 드 론으로 수집한 정보가 증거능력을 가질 수 있는 요건을 분석해보고 미국 각 주의 입법례를 참고하 여 드론과 관련된 국내 법률의 개선 방안을 모색 해 보고자 한다.

영어초록

Recently, some legal issues occur as drone-related industry develop quickly. Especially criminal investigation with drone technology causes infringe of individual privacy, it is urgent that we should make legal device for protection of basic human rights. So this paper looks into the drone-related regulation in the Civil Aeronautics Law and privacy protection from surveillance of drones in the Korean Personal Information Protection Law. And this paper compares domestic legislation with U.S. law and analyzes them. This paper particularly analyzes the requirements that the collected informations using drones can get admissibility of evidence, and finds the improvement plan of domestic drone-related laws referring to the state’s legislation of U.S.
